Terms of Service

This is an informational translation. The binding version is the Polish one, available at naszwielkidzien.pl/regulamin.

These Terms of Service set out the rules for using the naszwielkidzien.pl website and the terms for providing the wedding website service by Nasz Wielki Dzień.

1. General provisions

These Terms of Service set out the rules for using the naszwielkidzien.pl website (the "Site") and the rules for providing services by Nasz Wielki Dzień (the "Provider").

Using the Site and ordering services constitutes acceptance of these Terms.

2. Provider's details

The Provider runs an unregistered business activity (działalność nierejestrowana) within the meaning of Article 5 of the Polish Entrepreneurs' Law of 6 March 2018 (Prawo przedsiębiorców). It is not entered in the CEIDG business register and holds no NIP or REGON number.

The Provider is not a registered VAT payer (subjective exemption, Article 113 of the Polish VAT Act). The prices given are final - no VAT is added to the amount due.

3. Scope of services

The Provider offers a service consisting of designing, building and maintaining an individual wedding website (the "Wedding Website").

The standard package includes: - a graphic design based on the theme chosen by the Client (one of the eleven themes available on the Site), - personalisation of colours, fonts, photos and content, - a welcome screen with a countdown to the wedding day, - a welcome section, - an order of the day, - an RSVP form with validation and email notifications, - a photo gallery, - an interactive map, - an information section (dress code, parking, accommodation), - song requests with guest voting, - a gift section, - a contact form and a footer, - a web address of your own (a name chosen by the Client within the naszwielkidzien.pl domain) for 12 months, - keeping the Wedding Website online for 12 months, - an SSL certificate.

A custom project (for example a hand-built site instead of a ready-made theme, or extra sections on request) is quoted individually and requires a separate order.

4. Placing orders

Orders are accepted electronically only - through the contact form available at /en/contact or directly by email at: kontakt@naszwielkidzien.pl.

An order is placed once: - a theme has been chosen and materials sent (photos, content, venue details), - the quote has been confirmed by the Provider, - a deposit or full payment has been made.

The Provider confirms receipt of the order by email within 24 hours of it being placed.

5. Prices and payment

The price of the standard package starts from PLN 300 gross - the final quote is confirmed individually by email correspondence.

The price includes: design, build, a web address of your own and keeping the Wedding Website online for 12 months. It does not include fees for any renewal after the year has passed.

Payment is made by bank transfer or BLIK, based on the details provided by the Provider. Payment is due within 5 working days of the order being confirmed.

Work on the order begins once payment has cleared.

6. Turnaround time

The standard turnaround time is 5 to 7 working days from the moment: - payment has cleared, and - the Client has provided all the necessary materials (photos, content, details).

The Provider will inform the Client by email of any delays resulting from incomplete materials.

7. Rights and obligations of the parties

The Client undertakes to: - provide materials (photos, text) they hold the rights or appropriate licences to, - provide truthful and complete information necessary to carry out the service, - make payment on time.

The Provider undertakes to: - carry out the service in line with the order and within the agreed time, - keep the Client informed of progress, - keep the data and materials provided by the Client confidential.

8. Revisions and changes

As part of the standard package price, the Client is entitled to two rounds of revisions before the Wedding Website finally goes live.

Revisions are submitted by email. Each round of revisions is completed within 3 working days.

Content changes after the Wedding Website goes live (for example updating times or the order of the day) are possible and are made free of charge for the duration of the hosting period, provided they do not require a significant change to the site's structure.

9. Right of withdrawal

A Client who is a consumer has the right to withdraw from a distance contract (prawo odstąpienia od umowy) within 14 days of concluding it, without giving a reason.

To exercise the right of withdrawal, simply send an unambiguous statement by email to: kontakt@naszwielkidzien.pl. Sending the statement before the deadline is enough to meet it.

Model withdrawal statement (you don't have to use it - an unambiguous statement is enough): "I hereby withdraw from the contract for the provision of a wedding website service concluded on [date]. Name: [...]. Email address: [...]."

Note - loss of the right of withdrawal. If the Client requests that work begin before the 14-day period ends, the Provider obtains the Client's explicit consent to start work before accepting the order, along with acknowledgement that once the service has been fully performed the right of withdrawal expires (Article 15(3) and Article 38(1) of the Polish Consumer Rights Act, ustawa o prawach konsumenta). Work does not begin until such consent has been given.

If the Client withdraws from the contract during work started at their request, they are required to pay for the services performed up to the point of withdrawal, in proportion to the work completed.

A refund will be made promptly, no later than 14 days after receiving the withdrawal statement, using the same payment method the Client used.

10. Hosting and domain

Keeping the Wedding Website online and the web address are included in the package price for 12 months from the date the Wedding Website goes live.

The gallery of photographs from the wedding remains available for one month from the date of the ceremony. Up to 300 photographs or 2 GB of data in total can be uploaded to the gallery, whichever limit is reached first.

After 12 months, the Client can renew for another year - the renewal cost is agreed individually.

If not renewed, the Wedding Website is taken offline and the address stops working.

11. Complaints

Complaints should be submitted by email to: kontakt@naszwielkidzien.pl, describing the way the service fails to match the order.

The Provider handles complaints within 14 working days of receiving them and informs the Client of the outcome by email.

12. Intellectual property

The graphic design of the Wedding Website created by the Provider remains the Provider's property until full payment has been made - once payment is made, the Client acquires a licence to use the design for their own Wedding Website.

The Client grants the Provider a royalty-free licence to use the completed project for portfolio purposes, unless expressly stated otherwise in the order.

Materials provided by the Client (photos, text) remain the Client's property.

13. Protection of personal data

Clients' personal data is processed in accordance with the Privacy Policy available at /en/privacy-policy.

The data controller is Bartłomiej Banakiewicz, operating an unregistered business activity under the "Nasz Wielki Dzień" brand. Contact: kontakt@naszwielkidzien.pl.

14. Final provisions

The Provider reserves the right to amend these Terms of Service. Clients will be informed of any material changes by email or through an update to the content on the Site.

Matters not covered by these Terms are governed by the Polish Civil Code (Kodeks cywilny) and other relevant provisions of Polish law.

These Terms apply from the date of publication on naszwielkidzien.pl.

15. Out-of-court dispute resolution

A Client who is a consumer can use out-of-court methods for handling complaints and pursuing claims.

Free assistance is available from the municipal or district consumer ombudsman (rzecznik konsumentów) responsible for the Client's place of residence, as well as from the Provincial Trade Inspectorate (Wojewódzki Inspektorat Inspekcji Handlowej), before which amicable dispute resolution proceedings can be initiated.

Information on the procedure is available on the website of the Office of Competition and Consumer Protection (UOKiK): uokik.gov.pl.

Using these methods is voluntary and requires the consent of both parties.
